Aims
Familiarization of students with the mechanism of functioning of the judicial authority, as a system of bodies designated to perform the jurisdictional function of the Romanian state.
Knowledge of jurisdictional mechanisms, especially the jurisdiction of justice, as a constitutional jurisdiction, of full degree, as the main tool for resolving civil disputes.
Knowledge of fundamental concepts, such as the organization of power and the organization of civil justice.
Course contents
I. Introduction to civil procedural law. Phases of civil process. Sources of civil procedural law. Classification and actions of civil procedural law. Application in time and space of the laws of civil procedure.
II. Principles of civil procedural law
III. Citation and communication of civil procedure documents
IV. The trial in the first instance. Conduct of the court hearing.
V. The lawsuit. Practical meanings.
VI. Counterclaim and counterclaim. Comparative table.
VII. Nullities in the matter of procedural documents.
VIII. Evidence. Common rules regarding the admissibility, administration and assessment of evidence
IX. Procedural incidents and acts of disposition of the parties in the civil process
