Course aims:

Understand legal concepts by a logical manner
Use of the legal language in the elaboration of professional projects
Use of acquired legal knowledge in order to solve situations through a fair legal solution

Introductory notions. Fundamental principles of civil procedure

Civil action – conditions for exercising the action. Classification of claims

Participants in civil proceedings. The court. The parties

Participation of third parties. Compulsory intervention

Participation of third parties. Voluntary intervention

Participation of the Public Prosecutor and of the parties in civil proceedings. Participation of the Public Ministry in civil proceedings

Jurisdiction – introductory notions. Subject-matter jurisdiction

Jurisdiction – introductory notions. Subject-matter jurisdiction depending on the value of the claim. Territorial jurisdiction

Procedural incidents regarding jurisdiction

Procedural defenses

Nullity of procedural acts

Evidence. Common rules on the admissibility, administration, and assessment of evidence

Lecture, discussions, knowledge consolidation through multiple-choice questions and case studies

Learning outcomes:

By the end of the course, students will be able to explain and apply the principles and stages of civil procedure, identify the roles of parties and third parties, determine jurisdiction, analyze procedural incidents, apply procedural rules to concrete cases, use legal reasoning for actions and appeals, and employ precise legal language in academic and professional contexts, integrating national and EU standards in procedural interpretation.
